Terms and conditions

These Terms and Conditions (“Terms”) govern your use of the plugeasy.in website, the Plugeasy application, and the services provided through them. By using any of these, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Definitions

• Company (“We”, “Us”, “Our”) refers to Plugeasy Technologies Private Limited, Bengaluru, Karnataka, India.
• Application refers to Plugeasy, the software program provided by the Company, including its mobile application.
• Platform refers to the Company’s charging station management system and the operator console provided as a service to charge point operators.
• Service refers to the website, the Application, the Platform, and the EV charging sessions initiated through them, together.
• You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

Eligibility and accounts

You may use the Service only if you can form a binding contract under applicable law. Where the Service lets you create an account, you agree to provide accurate information, to keep it current, and to keep your credentials confidential. You are responsible for activity that occurs under your account. Some charging sessions can be started without an account; these Terms apply to those sessions as well.

Charging sessions and payments

Charging tariffs, and any applicable taxes or fees, are shown to you in the Application or at the charging station before a session begins. Starting a session constitutes acceptance of the displayed tariff. Payments are processed through the payment methods offered in the Application, which may be operated by third-party payment providers subject to their own terms.

Charging stations are operated either by the Company or by independent charge point operators using the Platform. Where a station is operated by a third party, that operator is responsible for the station’s physical condition, electricity supply, and site access.

You agree to follow the instructions displayed at the station and in the Application, to use equipment only as intended, and to not interfere with a station, a connector, or a session that is not yours.

Services to charge point operators

Use of the Platform by charge point operators is governed by the agreement entered into between the operator and the Company. In the event of a conflict between these Terms and that agreement, the agreement prevails for the Platform services it covers.

Acceptable use

You agree not to:

• use the Service in violation of any applicable law or regulation;
• interfere with or disrupt the Service, its servers, or its networks, or attempt to probe, scan, or test their vulnerability without our written authorisation;
• reverse engineer, decompile, or disassemble any part of the Service, except to the extent such restriction is prohibited by applicable law;
• access the Service by automated means in a manner that imposes an unreasonable load on our infrastructure;
• misrepresent your identity or your affiliation with any person or entity.

Intellectual property

The Service, including its software, design, text, graphics, and trademarks, is owned by the Company or its licensors and is protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. No other rights are granted.

Third-party services and links

The Service may contain links to, or depend on, websites and services that are not operated by us, including payment providers and map services. We have no control over and assume no responsibility for their content, policies, or practices. Your use of them is subject to their own terms.

Availability and changes to the Service

The Service is provided on an “as is” and “as available” basis. We may suspend parts of the Service for maintenance, and we may modify or discontinue features of the Service. We will use reasonable efforts to minimise disruption, but we do not guarantee that the Service, or any particular charging station, will be available at any given time.

Disclaimer of warranties

To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any warranty or right that cannot be limited under applicable law.

Limitation of liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Indemnity

You agree to indemnify and hold harmless the Company and its officers, directors, and employees from claims, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.

Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if continued access poses a risk to the Service or to others. You may stop using the Service at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) survive it.

Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory provision of applicable law, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or the Service.
